Amendments to the Constitution Essay -- First Amendment, Second Amend
The framers of our Constitution knew that time has a way of changing countries and their citizens. Our country was in a whirlwind of change in 1789 as people were experiencing freedom from the tyranny of England for the first time in their lives. Our country was being molded and formed into a great nation by the founding fathers. Expectations and rules had to be set to protect the rights of the minorities and majorities. Amendments to the Constitution were written to ensure equality for all in changing times. The First Amendment is one of the most recognized rights in the Bill of Rights. It is a basic right that seems to help define each person as an individual yet as part of an association. The amendment states that ââ¬Å"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievancesâ⬠(Constitution, Amendment 1) This amendment gave the right to secure and practice any religion. Religion was the reason that the Puritans left England. They wanted to be free to start their own churches and be free from religious persecution. The first amendment allows individuals the right to be part if any religion, if any, of their choosing. The vast majority of religious associations attest to this amendment: Catholics, Protestants, Scientologists, Jews, Hindus, and many, many more. United States citizens also enjoy the right to express themselves and their opinions in printed form or verbally. This is known as the freedom of the press. There are restrictions within reason, such as restrictions on libel and slander, and obscene act... ...ad a ban on handguns for 32 years. The ruling states that the Second Amendment guarantees the individual right to posses a firearm, even if they have no connection to a military organization, as long as the firearm is for law abiding reasons, such as self-defense in the home. (Fields, 2010). The First and Second Amendments will forever be ââ¬Ëcontemporary issuesââ¬â¢. The rights that are guaranteed to us are the same ones that allow us to question our government and allow for change. It will be a challenge for our courts to keep up with the changing times yet keep our rights intact. These rights are part of the foundation of our society. The framers had insightful intent to include the basic rights of all people for generations. Our great nation has flourished because of these rights- they allow each all of us to be unique individuals while being completely whole.

Comparison of Popes The rape of the Lock and Swifts A Modest Proposal
Although Alexander Pope's, The Rape of the Lock, and Jonathan Swift's A Modest Proposal are both witty satires, they differ on their style, intention, and mood. To begin, in The Rape of the Lock, Alexander Pope uses satire to invoke a capricious, melancholy mood to illustrate the absurdity of fighting over the cutting of one's hair. Hidden inside this poem is a crafty criticism of the society that helps create the crisis over the stolen lock. A Society in which appearances ere more important to a personââ¬â¢s sense of identity, and treats the insignificant with utmost importance. The very title of this mock- epic gives the audience a clue, the word "rape" and all its implications bring to mind a heinous crime of violation. Pope chose to utilize the heroic couplet to trivialize this mock- epic ââ¬Å"But when to mischief mortals bend their will, how soon they find it instruments of ill!â⬠(3. 53-54). When communicating with others the content of the message needs to be clear, but it also needs to be said in a clear way. When receiving messages it is necessary to be alert to both verbal (spoken) and non-verbal (body language) messages. To communicate effectively keep in mind factors such as ââ¬â environ ment: Are noise and activity levels too high? Do you need privacy? Would it be easier to have this conversation while carrying out an activity ogether? Walking or working side by side can ease the flow of conversation. Proximity: The better you know a person the closer you are likely to be physically. Closeness can encourage sharing. Positioning chairs at an angle rather than side by side makes it physically easier to talk to another person. Sitting directly opposite is more formal and can feel confrontational. Sometimes a table between you helps a person feel protected. Yelling from one room to another doesnââ¬â¢t aid communication!Orientation: Leaning forward can communicate that you are interested, but too close might invade ââ¬Ëbody spaceââ¬â¢. Turning away can show lack of interest, but standing directly opposite a person can be too direct, where being at an angle can provide a helpful space. Posture: Folded arms can look defensive and discourage communication. Friends and family without realizing, often mirror the other personââ¬â¢s posture during conversation, which is thought to increase a sense of familiarity. Standing over a person who is seated might feel patronizing or threatening.Touch: A light touch on a personââ¬â¢s arm or hand can communicate caring and understanding, but sometimes touch can feel intrusive, even threatening. There are also factors such as literacy skills, Literacy skills refer to a personââ¬â¢s competence in reading, writing and speaking in a particular language.The service users you work with may be at different levels of competence in literacy and need to be communicated with at a level they can cope with. Some adults struggle with literacy and may feel embarrassed by their difficulties. As well as literacy skills, some individuals will have better access to and be more competent using information and computer technology (ICT) than others. You should not assume that everyone you have dealings with at work has access to the internet and email, or mobile phones, or that they are competent in using such technology. . 2IDENTIFY BARRIERS TO EFFECTIVE COMMUNICATION. Communication is not always straightforward and a number o f barriers can be encountered when working in health and social care settings. Communication is a complex process and can be interrupted at any stage by a number of different barriers for instance ââ¬â when someone cannot receive or pass on information because they have an impairment to one or more of their senses, most commonly a visual or a hearing disability or communication is affected by the environment that people find themselves in.For example, someone who does not see very well will struggle to read written information in a dimly lit room. There are also barriers faced due to cultural differences when the same thing means different things in two cultures, communication can be difficult or when a person uses language that not everyone uses, such as saying they have a problem with their waterworks. Issues â⬠politics Essay
Boeing is one of the worldââ¬â¢s best known manufactures of aircrafts and so is Northrop Grumman who are the manufacturers of the airbus (Online News Hour, 2008). These are two top brands who are obviously competing in other areas of business and therefore any decision that involve them is bound to raise considerable heat. It should b noted that both are American companies though Northrop Grumman is partly owned by a French company. The nature of the contract which involves the security of America as a nation is a matter of national concern as it involves the development of structures that could ensure the growth of security systems. Boeing and Grumman being business structures, such a big contract will obviously attract the interest of stakeholders from both sides. There are a number of key issues that have been brought out by the airforce contracts which include: Military contracts are a matter of public concern since it is in place to protect the public, the resources used in the military contracts are derived from taxpayers and therefore the failure of such projects will be a waste of taxpayers money (Meyer, 2007). When McCain questioned the cost effectiveness in leasing planes that would otherwise have no values when their lease period was over his motive as the senator of Alabama was to ensure that the taxpayers money is channeled to useful projects. Furthermore, it is quite clear that the politicians have the ability to shoot down potentially useful deals due to what Northrop Grumman executives refer to as expensive lobbying. Politics is not always objective for there are situations where the stakes involved are shielded from the public and though the politics and viewpoints will be developed to suit the public, the real reasons are often personal (Meyer, 2007). The inclusion of politics in such cases therefore has both advantages and disadvantages and should be weighed carefully. Military procurement just like any other public procurement scheme is prone to corruption, this was the case in the original contract that was brought to an end by Rumsfeld in 2006. Moreover, the big money involved in military procurement processes act as a natural catalysts for corruption, therefore there is need to come up with a robust self regulated systems that will ensure that such unethical practices are not in anyway included in the procurement process, the congress thus comes into the picture (Meyer, 2007). However, the political system is not known for its objectivity. In the cases, some of the reasons brought out against Northrop Grumman are flimsy and lack in objectivity. The fact that there will be lobbying is a clear sign that there will be loss in objectivity thus the decision will tend to favor groups that are be able to garner enough political support in the congress. Furthermore, the political system is one of the most corrupt system there is and the rationale in placing such a system to guard against corruption is questionable. i.Security Military procurement is a security critical matter (Meyer, 2007). The military is in place to ensure that the US is protected against its external enemies (Meyer, 2007). The seriousness with which the equipment tendering process is treated and the keen eye that the media watches the unfolding of such events relay the importance placed on the military by the American people. The US is traditionally a ââ¬Ëfighting nationââ¬â¢ and the effectiveness of its military and equipments is one of the factors that has cemented its place as a world power. Military activities require high levels of secrecy (Meyer, 2007). There is need to come up with effective equipments that can be used in varied situations. It should be noted that the arguments brought forward by the executives from both sides are centered around the superiority of their products or the weaknesses of their opposite. The need for accuracy and well developed products that have the required reputation are some of the considerations that led to the two big companies making it to the final stage. The two companies are multinationals that have developed their brands all over the globe. It is noteworthy that when the US defense secretary cancels Boeingââ¬â¢s leases other nations still seek their products and are continues seeking the products that have been labeled cost ineffective due to the reputation associated with their brand name. The importance of the security system is seen in the number of avenues and legislative systems that have been put in place to ensure that the process is done in a just manner (Krishnan, 2008). When the airforce declares that Northrop Grumman had won the bid for the airforce tankers, Boeing seeks redress through a different avenue: Public accountability office. The office looks at their complaints and decides to freeze the process. It should be noted that it was the same office that had early in the decades frozen a billion dollar Boeing contract due to corruption charges. Even though there are systems put in place to ensure proper procedures in procurement of services and services, they can be outdone easily (Krishnan, 2008). The corruption allegations made in the initial Boeing contracts are a clear case where the protocols were overridden and it only came to realization a couple of months after the contracts had been signed. Furthermore, the fact that is was later found out that a different design could meet the specifications made by the airforce with reduced costs clearly show that even though the guidelines are put in place they are rarely followed thus the need for a system or authority that will follow up on the recommendations and processes to ensure that they conform to the laid out guidelines. Some politicians have argued that the French affiliation of the airbus manufacturer is in itself a security risk and therefore a purely American company should be contracted. However, such a contracting systems will obviously lock out other capable companies and therefore bring about questions on the integrity of the bidding process. America has prided itself as being a liberalized nation, putting up measures that will lock out other qualified members on the basis of the compositions of its investors is contrary to the spirit of liberalization. Furthermore, being involved with a company that has partnered with a success story in Europe shields the tanker project from American economic downtimes though it effectively ensures that the project is affected by the happening in Europe. It is unrealistic to lobby for Boeing on the basis of confidentiality; a company that has already shown traces of corruption cannot be trusted and neither can a company that is yet to prove its worth in the military sector. Therefore, system should be put in place to ensure that the projects are monitored and compared to some given standards if either is to be awarded the contract. ii. Stability The US is the father of capitalism and is therefore a country that is characterized by intense competition between industry players who will always be on the look for additional finances that will ensure their development into the future (Verkuil, 2007). On the day it was reported that Northrop Grumman had won the military contracts its share prices rose by over 20 cents and Boeingââ¬â¢s shares fell by a couple of cents (CBS News, 2008). Note, the development in the contract procurement were being watched by investors who will then make their decisions on which company to invest in. Even though the large money involved in the transactions may be enough to lure investors into channeling their resources to a particular company, the reputation involved in being a company contracted with one of the worldââ¬â¢s best airforce to develop its aircraft tankers is enough to cause significant changes in the companyââ¬â¢s share index. Being a capitalistic economy where entities gain at the expense of others, Boeing is bound to feel the pinch. The situation is made worse by the consideration that Boeing has a well developed reputation and therefore failure to win a contract from a partner that it has associated with for a long time may be taken by the investors and its consumers in the wrong light. It may imply that the partner does not trust its capacity to develop superiors products or has doubts on its potential to remain productive. To bring the idea of reputation into perspective, many are of the notion that the corruptions charges brought against Boeing may have affected its chances of successfully bidding for the contract (Verkuil, 2007). This holds considerable weight in that the military is not all about facilities but also reputation. The American people and its enemies will always keep a keen eye on the military and any transactions conducted with a partner who is proved to be corrupt will dent on its integrity thus its reputation. Conclusion Awarding a contract to a company to deliver services that are of public interest is a complex process and will always involve the media and many other systems that have been put in place to ensure the safety of the public. Individual good and interest will always be central in the arguments brought forward by most people, this is more pronounced if the contract will significantly affect many people. It is therefore upon the government and the social systems to ensure that the systems put in place to ensure effectiveness of the bidding process are functioning properly and are robust enough to deal with the dynamism associated with such processes. If need be, changes must be instituted to ensure that the system are functioning. The products delivered must measure up to some predetermined standards to ensure quality and accountability. These measures and other quality management measures if well integrated into the bidding and implementation of contracts that are of public interest will ensure that the public benefits in the best possible way. Florence Kelley
Florence Kelley (1859 ââ¬â 1932) Florence Kelley, A Woman of Fierce Fidelity Florence Kelley is considered one of the great contributors to the social rights of workers, particularly women and children. She is best known as a prominent Progressive social reformer known for her role in helping to improve social conditions of the twentieth century. She has been described as a woman of fierce fidelity (Goldmark, 1953). Kelley was a leading voice in the labor, suffragette, childrenââ¬â¢s and civil rights movements. She was also a well-educated and successful woman, a rare combination during the turn of the twentieth century.Kelley was born in Philadelphia, Pennsylvania on September 12, 1859 to Quaker parents, William Darrah Kelley and his second wife, Caroline Bartram. Her father was a self-educated man who left his business to become an abolitionist, a judge and an activist for a number of political and social reforms. Kelley had two brothers and five sisters; however, all five s isters died in childhood. The childhood memory of the deaths of her five sisters influenced Kelleyââ¬â¢s lifelong fight for government funds for maternal and child health services.The political climate during the life of Kelley and the influences of her family, education, travels and friendships contributed to her commitment to social reform. It was these influences that led this determined woman to have a profound impact on the quality of life for many individuals during her life and thereafter. Letââ¬â¢s examine these influences in more detail for a better understanding of this remarkable woman and reformer. Kelley had the good fortune to grow up in a progressive, cultured and affluent family. It was a family actively devoted to social reform and this devotion influenced Kelley.She was educated at home for most of her childhood due to being sickly as a child. Her father taught her to read at age seven and made his extensive library available to her. Her father also influence d her social conscience by taking the young Florence with him as he toured factories where young boys worked to help manufacture steel and glass. Kelley begins her autobiography by describing her father as a ââ¬Å"companionship which has enriched my whole lifeâ⬠and credited him with encouraging her interest in public life. (Kelley, 1926).It was on the factory tours with her father that Kelley first witnessed the horrendous conditions and danger that children were forced to work under. She often stated that through this experience, she developed her enthusiasm to advocate for child labor reform. While still a young woman, Kelley wrote, ââ¬Å"We that are strong, let us bear the infirmities of the weak. â⬠(Sklar, 2009). At the encouragement of her father, in September 1876, at the age of seventeen, Kelley entered Cornell University, College of Arts and Sciences.After completing her studies at Cornell, Kelley attended the University of Zurich the first European university open to women where she studied politics, economics and law. While in Europe, Kelley formed friendships with people that embraced the teachings of socialism. It was during this time that Kelley began translating the works of known socialists, Karl Marx and Friedrich Engels. Her translation of Engels ââ¬Å"The Condition of the Working Class in England in 1844â⬠was published by New York Socialists in 1887.In 1884, while attending the University of Zurich, Kelley met and married Lazare Wischnewetzky, a Russian medical student and member of the socialist party. Kelley and her husband moved to New York City in 1886. Her husband was abusive, and, in 1889 Kelley left her husband and moved to Chicago with her three young children. The marriage ended in divorce in 1891. It was in Chicago that Kelley turned to the study of social conditions taking a special interest in women and children. Florence boarded her three children while she became a resident of the Hull House with Jane Addams and other female social reformers.The Hull House was a settlement house established to ease the suffering of the urban poor, improve unfair and dangerous working conditions and reform government to protect workers. Settlement houses were created to help the urban poor and to assist college educated women to find meaningful employment and to professionalize the social sciences of Sociology and Social Work through collecting statistics, reports and photographs. At the turn of the century, many Americans hoped to improve society for the better. These reform-minded citizens were called Progressives.Kelley was among the Chicago women of her class that strongly believed that they belonged in the public arena calling attention to the working conditions of children and women, social injustice and democracy for all. These Progressives wanted to use the government as an agency of reform and they believed grassroots efforts at the local level would spread to the state and then national level. They embraced strong efforts to address the corruption of government and to make government more efficient. Kelley and the women of the Hull House actively campaigned for civil rights, childrenââ¬â¢s health and welfare and prohibition.During her years of work at the Hull House, Kelley participated in the documentation of urban poverty. Kelley pioneered the use of scientific data to influence the decision of the U. S. Supreme Court. (Goldmark, 1953). In 1892, Kelley was hired by the Illinois Bureau of Labor Statistics to investigate the sweat shop activity in the garment industry. In this position, Kelley was responsible for providing the numerical evidence that led to state legislation mandating an eight-hour work day for women and children. The law, enacted in 1894, was repealed the following year under pressure from the Illinois Association of Manufacturers.Kelley held the position with the Illinois Bureau of Labor and Statistics until 1897 when she was appointed the first wom an Chief Factory Inspector by Illinois Governor John P. Atlgeld. Kelley was very successful in recruiting people to socialism. She told Friedrich Engels: ââ¬Å"We have a colony of efficient and intelligent women living in a working menââ¬â¢s quarter with the house used for all sorts of purposes by about a thousand persons a week. The last form of its activity is the formation of unions of which we have three, the clock-makers, the shift-makers,, and the book-binders.Next week we are to take the initiative in the systematic endeavor to clean out the sweating dens. The Trade assembly is paying the expenses of weekly mass meetings; and the sanitary authorities are emphasizing the impossibility of their coping, unaided, with the task allotted to them. â⬠Kelleyââ¬â¢s frustration with the repeal of the eight-hour work day law for women and children and the difficulty in prosecuting the sweat shop cases influenced her to enroll at Northwestern University where she earned a law degree in 1894.In 1899, Kelley returned to New York to assume the leadership of the National Consumersââ¬â¢ League, an organization created to use the purchasing power of the consumer to support firms with good labor practices. She remained with this organization for over thirty years. In this role, Kelley, pioneered the use of white labels on clothing to certify garments had been produced without child labor and within the parameters of the legislation regulating factory work. During her time with the Consumerââ¬â¢s League, Kelley traveled extensively, speaking to various rganizations and was responsible for organizing sixty different leagues in twenty different states, plus two international conferences. Kelley played a prominent role in federal legislation for child labor minimum wages. A strong supporter of womenââ¬â¢s suffrage and African American civil rights, Kelley helped form the National Association for the Advancement of Colored People (NAACP) and the Womenâ⬠â¢s International League for Peace and Freedom. In September 1905, Kelley joined Upton Sinclair and Jack London to form the Intercollegiate Socialist Society.Its stated purpose was to ââ¬Å"throw light on the world-wide movement of industrial democracy known as socialism. â⬠Kelley spent the next several years as a frequent speaker on American campuses. She recruited Frances Perkins, a student to the cause and Perkins is the person responsible for bringing an end to child labor in America. Kelley wrote several books including Some Ethical Gains Through Legislation (1905), Modern Industry in Relation to the Family (1914), The Supreme Court and Minimum Wage Legislation (1925) and Autobiography (1927).Kelley also helped establish what became known as the ââ¬Å"Brandeis briefâ⬠(named for Justice Louis D. Brandeis), a process of integrating facts and experiences in legal action to demonstrate the need for changing laws according to human realities. Florence Kelley died in G ermantown on February 17, 1932 after a long illness at the age of seventy-three. Kelley was a fascinating woman that dedicated herself to serving the victims of industrial capitalism. She is among the founders of the U. S. welfare system and is considered not only a powerful woman for social justice but also a representative of womenââ¬â¢s empowerment.Kelley is quoted as saying, ââ¬Å"In order to be rated as good as a good man in the field of her earnings, a woman must show herself better than he. She must be more steady, or more trustworthy, or more skilled, or more cheap in order to have the same chance of employment. â⬠It is easy to conclude that Florence Kelley was ahead of her time in her ideas and approach to social reform. She laid the groundwork for many social programs that were not implemented until after her death. Her many accomplishments have contributed to an awareness of the rights of children and the working class in America.

Rather, it is a distance that i allow to fester until it destroys the relationship I have with the family member. Now I realize that it is never a bad thing to admit guilt for it can help to build or rebuild relationships instead. I am happy that I heard his message. It has helped me to change my outlook in life. Jamaica Orsorio speaks of how the immigrants of America have forgotten their homeland roots so much that they no longer even recall their parents original names. She speaks of the pain of losing ones heritage forever as the immigrant becomes more Americanized in look and language. With their adaptation of the American way of life, their roots shall die because no one shall be left to remember how their race once lived. Immigrants are people who come to the United States for a better life. Unfortunately, the better life means having to let go of their past. Ignoring their heritage and adapting the new one for their benefit. As I listened to Ms. Orsorios words, I could not help but wonder about how her message did not apply merely to her race, but to all the immigrants living in the United States. Heritages die out because of the Americanization of immigrant families. It makes me wonder if their immersion into the American way of life is a bad or good thing. After all, culture and heritage are the ways by which civilizations continue to grow and evolve. Once people forget their roots, their culture and heritage dies. I am quite sad as I sit here imagining a world with with only culture and heritage which is what will happen to the United States as the immigrant families continue to adapt to the American way of life. However, maybe, just maybe, it is a necessary evil that in turn helps the American w ay of life
